The Lanham Act does not provide protection for descriptive trademarks because they are not inherently distinctive, except when they have acquired a secondary meaning. In addition, the descriptive/geographic terms and names that are personal is not inherently distinctive; this would not obtain law protection until they obtain a secondary means.
