Hey there!
It was the majority opinion that led justice black criticized as part of his argument in the dissent. All of the so called "votes" were opinions, they weren't facts. So, from his criticized part of his argumentative reaction, the other people saw this and actually it was a opinion, it was the majorities opinion.
