Should a state have the power to kill a person for breaking the law?

(this is on my math but it seems more like a history question)

For the question to biased it would have to be formulated like this: "Should a state have the power to kill a person for breaking the law, leaving the federal courts with no decision power regarding these matters, potentially increasing the chance of an erroneous verdict?".
