The Supreme Court is viewed as an independent branch of government. This is accomplished in a number of ways. The most important of these methods is the appointment of judges for life. Another method is judicial review, which involves mandating certain actions when a branch of government is perceived to be refusing to perform a constitutional duty or function.
There are several ways the Constitution protects the independence of the Judicial branch including:
- Making the position of a Justice permanent
- Prohibiting the reduction of the salaries of Justices while they hold the position
By making the position of a Federal Justice permanent, the justices do not have to worry about pleasing anyone in order to keep their position thereby making them more independent.
Justices also cannot have their salaries decreased while they are Justices and so they are more independent as they are not worried about people coming after their livelihood.
In conclusion, the Constitution came up with several ways to protect Judicial independence.
