The absolute privilege is a complete defense to the torts of trade libel, slander of title, and defamation when applicable.
The absolute privilege makes statements made in judicial proceedings, legislative proceedings, and certain executive/administrative proceedings absolutely privileged even if the person making the statement made the statement intentionally and knowing it was false. This means that an intentionally false statement in one of these proceedings can not be the basis of a claim of defamation , slander of title or trade libel.
Question:
If I file a compla/int in court falsely stating that my eye doctor is a crook and the glasses he makes are complete junk, can I rely on the defense of absolute privilege to defend a subsequent case by my eye doctor for trade libel and defamation?
